Under U.S. law, refugees must apply for legal permanent residency one year after arriving in the country. The new memorandum authorizes immigration authorities to detain these people during the reinspection process.

The new policy marks a change from the previous 2010 memo, which stated that failure to obtain lawful permanent resident status it was neither a “basis” for removal from the country nor a “proper basis” for detention.
